Terms of Service

These Terms of Service ("Terms") govern your access to and use of Fathoms Deep — the game client, launcher, website, and related services (together, the "Service"), operated by AsloWaves ("we", "us"). By creating an account, downloading the launcher, or otherwise using the Service, you agree to these Terms.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under the age of majority where you live, you may only use the Service with the consent of a parent or legal guardian.
2. Accounts
- You are responsible for keeping your account credentials secure and for all activity under your account.
- Provide accurate information when registering, and keep your contact email current.
- One account is intended for a single person; do not share, sell, or transfer accounts.
- Notify us promptly at mathewjmullen@gmail.com if you believe your account has been compromised.
3. Acceptable use
You agree not to:
- Cheat, exploit bugs for unfair advantage, or use unauthorized third-party software (bots, hacks, or automation) that affects gameplay.
- Harass, threaten, or abuse other players, or post unlawful, hateful, or infringing content.
- Disrupt, overload, or attempt to gain unauthorized access to the Service or its servers.
- Reverse engineer, resell, or commercially exploit the Service except as permitted by law.
4. Beta / in-development software
Fathoms Deep is in active development. The Service is provided on an evolving basis: features, content, virtual items, and progress may change, be reset, or be removed, and downtime may occur. We do our best to communicate significant changes.
5. Purchases & virtual items
The Service may offer subscriptions or virtual items in the future. Any prices shown before that system is live are examples and may change. Virtual items have no real-world monetary value, are licensed (not sold) to you, and may be modified or discontinued. Payment-specific terms and refund policy will be provided at the point of purchase when checkout goes live.
6. Intellectual property
The Service, including its software, art, audio, and trademarks, is owned by AsloWaves or its licensors and is protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial play, subject to these Terms.
7. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service and its players. Sections that by their nature should survive termination (e.g., intellectual property, disclaimers, limitation of liability) will continue to apply.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including fitness for a particular purpose and non-infringement.
9. Limitation of liability
To the fullest extent permitted by law, AsloWaves will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, profits, or goodwill, arising from your use of the Service.
10. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above, and where appropriate we will provide additional notice. Continued use of the Service after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of [your governing jurisdiction — to be set before launch], without regard to conflict-of-laws rules.
